Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the VolleyEngine Pro iOS application and related website (collectively, the "Service") operated by VolleyEngine Pro ("we", "us", "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Apple-Sourced App: These Terms incorporate by reference the Apple Licensed Application End User License Agreement ("Apple EULA") available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms conflict with the Apple EULA, the Apple EULA controls with respect to apps downloaded from the Apple App Store.

2. Eligibility and Accounts

• You must be at least 13 years old to create an account. If you are under 13, a parent, guardian, coach, or club must create and manage the account on your behalf.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate information and keep it current. Accounts for players may be created and administered by a parent, guardian, coach, or club.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Harass, threaten, bully, or harm other users, including through team chat or messaging features;
• Upload or share content you do not have the right to share, including images or recordings of others without their consent;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Copy, modify, reverse engineer, or create derivative works of the Service except as expressly permitted by law;
• Use the Service to compete with us or resell access to it.

We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

• Certain features (e.g., coach team-management plans) are offered as auto-renewable subscriptions purchased through the Apple App Store.
• Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• You can manage or cancel subscriptions in your Apple ID account settings on the App Store after purchase. Cancelling stops the next renewal; access continues until the end of the paid period.
• All billing and refunds are handled by Apple under its policies. We do not process payments or store payment card details.
• Prices are subject to change with notice; changes apply only to subsequent renewal periods.

5. Your Content

You retain ownership of content you create or upload (e.g., team rosters, practice plans, play designs, chat messages). You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display your content solely as necessary to provide the Service to you and the team members you share it with. You are responsible for the content you submit and for having any needed consent from people appearing in recordings you save or share.

6. AI Features Disclaimer

The Service's pose tracking, hit detection, practice generation, and other AI-powered features provide estimates and training suggestions for informational purposes only. They are not medical, safety, or professional coaching advice. Always consult a qualified professional before changing your training regimen, and never rely solely on the app for injury prevention or health decisions. Use the app's live camera features safely and responsibly, with proper space and warm-up.

7. Availability; Changes

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, or remove features, and may suspend or discontinue the Service, at any time. Your data stored via Firebase may be unavailable during maintenance or outages.

8. Disclaimers; Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST DATA, LOST PROFITS, OR SPORTS-RELATED INJURIES. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms or to protect other users. Upon termination, the license granted to you ends, and sections intended to survive (including 4, 5, 7, 8, and 10) remain in effect.

10. Governing Law; Contact

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules, and nothing in these Terms affects your mandatory consumer rights in your country of residence. Any disputes will be handled as described in the Apple EULA where applicable.
